We represented a client charged with eight counts of driving while disqualified committed over a period of just six weeks. At the time of the offending, he was already subject to a Community Correction Order for the same conduct, placing him at significant risk of a custodial sentence.
We prepared detailed material addressing the client’s circumstances, the underlying reasons for the repeated offending, and the steps he had taken to stabilise his situation. At sentence, we submitted that despite the seriousness and frequency of the breaches, his rehabilitation was progressing and that a community-based penalty would be more effective than imprisonment.
The Court accepted our submissions. The client avoided a custodial sentence and was dealt with by way of further Community Correction Orders. Importantly, the Court imposed a total licence disqualification of only six months for all eight offences combined.
Outcome: No imprisonment. 6 month total disqualification.
