Our client was charged with mid-range drink driving following a work-related Christmas function. He had made the decision to drive home after consuming alcohol and was stopped by police after failing to stop at a red traffic light. His blood alcohol reading was 0.134, placing the offence squarely within the mid-range category.

While the circumstances of the offence were serious, the client had no prior record and was otherwise a responsible member of the community. He was genuinely remorseful and took full responsibility for his decision. We immediately advised him to complete a recognised traffic offender program and to obtain supporting materials that would properly demonstrate his character, insight and commitment to rehabilitation.

After preparing the matter thoroughly, including the presentation of compelling material at sentence, we appeared before the Local Court and made detailed submissions on the client’s behalf. The magistrate was ultimately persuaded not to record a conviction, enabling our client to retain his licence and continue his employment without interruption.

This outcome reflected both the strength of the preparation and the careful handling of a matter that could have otherwise carried significant consequences.
