This client was accused for the eighth time in a series of offences involving his vehicle. He faces the possibility of completely losing his licence, having it suspended, or being disqualified altogether. This incident not only breached three CCOs but also held the potential for imprisonment. Initially, he was denied bail, with a sentencing date set for the following day. At that moment, we recognised him as a genuine business owner. The financial stability of his family depended on him, and he had stayed drug-free for two years. During this time, he took care of his grandmother’s landscaping while she struggled with dementia. Therefore, instead of serving his sentence in a conventional prison, he will do so in the community. The client was granted a six-month ICO once this viewpoint was acknowledged.

We effectively defended a client dealing with his eleventh offence for driving with a disqualified licence, which was complicated by prior jail time and violations of his Community Corrections Order. Through thorough preparation and compelling arguments, we requested the court to impose a six-month disqualification along with a new Community Corrections Order to avoid further incarceration.
