A fixed speed camera captured our client travelling more than 30 kilometres per hour above the posted limit in a Sydney tunnel. The offence exposed the client to a minimum three-month licence disqualification, which would have seriously affected the operation of a small business and the family income. Our client was charged with reckless grievous bodily harm and affray following an altercation outside a Sydney nightclub. The complainant sustained fractures to the jaw, cheekbone and nose that required surgery and the insertion of metal plates. Police alleged that our client had initiated the violence. We carefully reviewed the police brief and analysed the available CCTV footage, which showed that another person had confronted our client before he responded. At the defended hearing, we exposed inconsistencies between the prosecution’s description of the incident and the recorded footage. The court found that the prosecution could not exclude lawful self-defence beyond reasonable doubt. Our client was acquitted of both charges and avoided any conviction or penalty.
