Use Mobile Phone While Driving – Section 10(1)(a) Outcome

    We represented a client charged with using a mobile phone while driving. He had a significant 15-year traffic history, and a conviction would have resulted in an immediate licence suspension. As the sole income earner for his family, the loss of his licence would have had substantial personal and financial consequences.

    The matter had initially been listed for hearing. After receiving further advice, the client entered a plea of guilty. We prepared material addressing his need for a licence, his responsibilities, and the impact a suspension would have on his family. Despite his poor traffic record and the lateness of the plea, the Court was persuaded that a conviction was not warranted. A section 10(1)(a) dismissal was granted, allowing him to keep his licence.

    Outcome: Section 10(1)(a), no conviction. No licence suspension.
