Bail Granted on Domestic Violence Charges

Table of Contents

We appeared for a client in a bail application after he was taken into custody for breaching both his bail and an AVO only hours after bail had originally been granted. He was facing serious domestic violence allegations and was understandably distressed at the prospect of remaining in custody.

We set out the client’s circumstances, the supports available to him, and the measures that could be put in place to mitigate any risks. Despite the very short time between the initial bail and the breach, the Court was satisfied that continued detention was not justified and granted bail on moderate conditions.

Outcome: Bail granted notwithstanding an immediate prior breach.
