Hindering and Concealing a Serious Offence. No Jail in the District Court

    We appeared for a client in the District Court who faced very serious charges of hindering and concealing a serious offence arising from a catastrophic car accident in which two young adults tragically lost their lives. Our client was a passenger in the vehicle and had declined to assist police during the investigation, conduct which significantly elevated the seriousness of the allegations.

    Despite the gravity of the case, we secured his release on bail, which he successfully maintained for 13 months while the matter progressed through the court system. In preparation for sentence, we gathered extensive material addressing his background, insight, and the steps he had taken since the incident.

    At the sentencing hearing, we advanced detailed submissions addressing his role, his prospects of rehabilitation, and the principles guiding the imposition of custodial penalties. The Court ultimately accepted that a term of full-time imprisonment was not required.

    The client avoided a jail sentence and was permitted to remain in the community.

    Outcome: No imprisonment in the District Court.
