Speeding More Than 30km/h Over the Limit, Licence Retained

A fixed speed camera captured our client travelling more than 30 kilometres per hour above the posted limit in a Sydney tunnel. The offence exposed the client to a minimum three-month licence disqualification, which would have seriously affected the operation of a small business and the family income. We advised the client to enter an early guilty plea and assisted with preparing an apology, character references, evidence of completing a traffic offenders program and documents explaining the importance of the licence. At sentence, we highlighted the client’s remorse, good record and personal circumstances. The magistrate imposed a Conditional Release Order without conviction, allowing the client to retain the licence and continue operating the business.

Serious Nightclub Assault Charges, Not Guilty

Our client was charged with reckless grievous bodily harm and affray following an altercation outside a Sydney nightclub. The complainant sustained fractures to the jaw, cheekbone and nose that required surgery and the insertion of metal plates. Police alleged that our client had initiated the violence. We carefully reviewed the police brief and analysed the available CCTV footage, which showed that another person had confronted our client before he responded. At the defended hearing, we exposed inconsistencies between the prosecution’s description of the incident and the recorded footage. The court found that the prosecution could not exclude lawful self-defence beyond reasonable doubt. Our client was acquitted of both charges and avoided any conviction or penalty.

Child Removed From ADVO, No Conviction Recorded

Police charged our client with intimidation and applied for an Apprehended Domestic Violence Order that included his one-year-old child. The conditions immediately prevented contact and interrupted existing parenting arrangements. We obtained character references and supporting material showing that the alleged conduct arose during a highly emotional incident and did not form part of an ongoing pattern. The magistrate accepted our submissions and finalised the criminal charge without recording a conviction. We also negotiated the removal of the child from the ADVO, allowing lawful contact and parenting time to resume. The final conditions continued to protect the parties while providing practical arrangements for communication, changeovers and the restoration of family routines.
